The International Comparative Legal Guide to: Project Finance 2016 – Panama

We are very pleased to share with you Patton, Moreno & Asvat’s contribution to the 2016 edition of The International Comparative Legal Guide to: Project Finance 2016, provides a practical insight into Project Finance development and regulation in Panama. The chapter addresses the most relevant issues in project finance laws and regulations, including security, bankruptcy and restructuring proceedings, restrictions, insurance and arbitration, among others. The chapter was a joint effort of our partner Ivette Martínez S. and our senior associate Nadya Price.

Overview

There is a significant and growing interest in the project finance market by both the Panamanian government and private companies. Such interest is sustained by an increase in foreign investment in Panama for major infrastructure projects led by the government, which has resulted in Panama being one of the fastest-growing economies in Latin America for the last 5 years.

The most significant project financings that have taken place in Panama in recent years have been related to major infrastructure projects, such as the expansion of the Panama Canal, as well as the expansion of Tocumen International Airport, with the construction of a new terminal. Other projects include the expansion of capacity of port terminals in the Canal area, the initial construction and expansion of the Metro system, as well as major projects in the power and renewable energy sector, including wind generation parks, solar projects and hydroelectric plants.
